In a significant move towards reforming the management and regulation of Waqf properties, the Indian government has notified the "Integrated Waqf Management, Empowerment, Efficiency, and Development Rules, 2025" under the Waqf (Amendment) Act. This new set of rules introduces a comprehensive framework for managing Waqf assets, which includes the creation of an online portal and database for property management, auditing, and maintenance of accounts. These changes are set to streamline the process of tracking and updating Waqf properties, ensuring greater transparency and accountability. Key Provisions of the Integrated Waqf Management Rules, 2025 The rules, once implemented, will require the uploading and updating of Waqf properties on the designated portal and database. This will allow for an automated system where each Waqf property will be assigned a unique identification number (UID), which will facilitate tracking and monitoring of these assets across various sectors. This initiative aims to bring more efficiency and organization to the management of Waqf properties across the country. The Ministry of Minority Affairs will be responsible for overseeing the operational control of the portal and database, ensuring the smooth functioning of the new system. The portal will allow Waqf authorities and Mutawallis (property managers) to register their properties by using a mobile number and email ID, further enhancing the transparency and accountability of the process. Automated UID Generation and Tracking System One of the key features of the newly notified rules is the creation of a unique identification number (UID) for each Waqf property. This number will be generated automatically by the portal and will play a crucial role in the future tracking and monitoring of these assets. The introduction of this system is expected to bring significant changes in the way Waqf properties are tracked, preventing disputes and unauthorized use. The UID will serve as a reference point for all future records, ensuring a more organized management system. Role of Mutawallis and Government Oversight The government’s move aims to streamline the process of registering and managing Waqf properties. Under the new system, Mutawallis, the appointed caretakers of Waqf properties, will be required to register properties using their mobile numbers and email addresses. This will make the entire process more accessible and transparent. In cases where complaints are filed about properties being wrongly declared as Waqf, the rules specify that the designated government official must complete the investigation within a year of receiving a reference from the district collector. This timeline is designed to ensure that issues are resolved in a timely manner, preventing delays in the legal process and addressing grievances quickly. Waqf (Amendment) Act 2025: The Legislative Background The Waqf (Amendment) Act 2025 was passed by the Indian Parliament in April, marking a major step towards modernizing the management of Waqf properties in India. The central government’s Ministry of Minority Affairs had earlier sent the draft rules to the Ministry of Law and Justice to ensure the smooth implementation of the amendments. The amendment aims to bring comprehensive reforms in the regulation, management, and utilization of Waqf properties. The new rules reflect the government's commitment to improving the governance and efficiency of Waqf properties, which have been plagued with issues of mismanagement and lack of proper documentation. Following the Supreme Court's decision on various petitions regarding contentious provisions, the government is now focused on drafting model rules for states to follow. Next Steps: State-Level Implementation and Model Rules Following the notification of the central rules, the next step involves the development of model rules for states to adopt and adapt. The Ministry of Law and Justice plans to set up a committee of retired officials and legal experts to formulate these model rules. States will be able to modify these rules according to their regional needs, ensuring that each state can implement the changes effectively while adhering to the core principles set out by the central government. Appointment of Nodal Officers for Waqf and Property Management In line with the new rules, state governments will be required to appoint a Joint Secretary-level officer as the Nodal Officer in each state. This officer will be responsible for coordinating the implementation of the rules within their respective jurisdictions. The Nodal Officers will work closely with the centralized support unit to ensure smooth functioning and compliance with the national framework for Waqf management. The role of these officers will be crucial in overseeing the updating of Waqf properties and the maintenance of accounts in accordance with the new system. Transparency and Efficiency in Waqf Property Management The introduction of an online portal and a centralized database system is set to bring transparency and efficiency to the management of Waqf properties in India. The automated system for generating unique identification numbers for each property will eliminate the possibility of duplicate records or disputes over property ownership. By centralizing the records and making them accessible to both government authorities and the public, the new rules will also help in reducing the chances of illegal occupation or mismanagement of Waqf assets. Furthermore, the regular auditing and maintenance of accounts will ensure that the funds and resources generated from Waqf properties are being used efficiently for the intended purposes, such as supporting religious and charitable activities. This will address long-standing concerns about the misuse of Waqf resources and improve the overall management of these valuable assets. Impact on Waqf Property Management and Religious Institutions The implementation of the Integrated Waqf Management Rules, 2025 will have a significant impact on how Waqf properties are managed across India. By enhancing transparency and establishing a clearer regulatory framework, the government aims to create a system where Mutawallis are held accountable for the upkeep of the properties under their charge. The rules will also provide a legal mechanism for addressing disputes and grievances related to Waqf properties, which has been a major issue in the past. The new system will be especially beneficial for religious institutions, educational establishments, and charitable organizations that rely on the proper management of Waqf properties to fund their activities. The proper tracking and management of these assets will ensure that funds are used effectively, benefiting the communities they are intended to serve. The notified rules for Waqf property management are a crucial step towards modernizing and empowering the Waqf system in India. The creation of a centralized portal, the introduction of unique identification numbers for properties, and the establishment of a streamlined process for property registration and monitoring will significantly improve the transparency and efficiency of Waqf management across the country. As the government continues to implement these reforms, the next step will involve developing state-level guidelines that will further enhance the management of Waqf properties in India. With the full implementation of these rules, the Waqf system is set to become more transparent, accountable, and efficient, ensuring that Waqf resources are used for the benefit of the communities they are meant to serve.
