Madras High Court Directs Chennai Police to Consider TVK’s Request for Demonstration on Custodial Deaths

In a significant legal development on Friday, July 4, 2025, the Madras High Court directed the Greater Chennai City Police to duly consider a representation from the Tamilaga Vettri Kazhagam (TVK), an organization led by actor Vijay, regarding permission for a demonstration condemning custodial deaths in Tamil Nadu. This move follows a petition filed by TVK, represented by its Deputy General Secretary, C.T.R. Nirmal Kumar.

Court’s Directive for Police Consideration

The Madras High Court, presided over by Justice P. Velmurugan, directed the Chennai City Police to review TVK’s representation regarding the proposed demonstration. The demonstration was intended to highlight the increasing number of custodial deaths in Tamil Nadu, which TVK claims have occurred since the Dravida Munnetra Kazhagam (DMK) party came to power in 2021. TVK, in its petition, claimed that 23 custodial deaths have been reported across the state during this period, prompting the need for public condemnation.

The court’s order came after TVK’s counsel, P. Vijendran, informed the court that the party had submitted a formal request to the Chennai police on July 1, seeking permission for the demonstration. The proposed demonstration was to be held at Sivananda Salai between 10 am and 1 pm on July 6, 2025, a Sunday. However, the Chennai police had raised objections regarding the proposed venue. Despite the party’s attempts to suggest an alternative location, those requests were also rejected by the police.

Disagreement Over Venue and Timing

The police’s refusal to grant permission for the originally proposed venue and the alternative venue prompted TVK to approach the court. The police raised concerns over the timing and location of the demonstration, asking for further clarifications, but TVK had not responded to these queries by the time of the court hearing.

In the court, Additional Advocate General J. Ravindran pointed out that the police had requested additional clarifications on July 3, but the petitioner did not provide the required response in time. The police’s concerns primarily revolved around the venue and timing of the protest, which TVK was adamant about moving forward with.

Justice Velmurugan’s Observations

After hearing the arguments from both parties, Justice P. Velmurugan observed that the police must be given a reasonable amount of time to review such requests. The judge noted that TVK’s request for a demonstration on July 6, just five days after the representation was made, was not feasible without allowing enough time for proper consideration by the police. He emphasized that a minimum of 15 days’ time should be given to the police to review the request and make an informed decision.

Therefore, the judge disposed of TVK’s petition with an instruction to the party to submit a fresh representation to the Chennai police. The new request should seek permission for the demonstration on an alternate day, giving the authorities the time needed to evaluate the application properly. Justice Velmurugan directed the police to duly consider the updated representation and issue appropriate orders accordingly.

TVK’s protest is rooted in a growing concern over the rise in custodial deaths in Tamil Nadu. The party alleges that since the DMK assumed power in 2021, at least 23 custodial deaths have occurred in the state, which they claim are a result of police brutality and human rights violations.
