Patna High Court Criticizes Bihar Government Over Rising Noise Pollution

KKN Gurugram Desk | Patna High Court has expressed strong disapproval of the Bihar government’s handling of rising noise pollutionĀ in the state. During a hearing onĀ Surendra Prasad’s petition, Justice Rajeev Roy highlighted that people are constantly suffering from different forms ofĀ pollution, and immediate action is necessary.

The court issued a strict statement regarding theĀ increasing noise levels in PatnaĀ and across Bihar, emphasizing the urgent need to address the issue. The next hearing on this matter is scheduled forĀ February 14, 2025.

High Court Appoints Senior Advocate as Amicus Curiae

To assist in the case, theĀ Patna High Court appointed senior advocate AjayĀ asĀ Amicus Curiae (friend of the court). During the hearing, he informed the court thatĀ orchestra, DJ systems, and cultural event organizersĀ are disregarding the impact ofĀ noise pollutionĀ on the public.

He further explained that despite the existence ofĀ strict noise pollution laws, many people continue toĀ violate sound regulationsĀ without facing consequences.

Loudspeaker and DJ Usage Violates Noise Pollution Laws

Senior Advocate Ajay informed the court that India’sĀ noise pollution laws clearly define restrictionsĀ on excessive sound levels.

  • Permission for Loudspeaker Use:Ā According to existing regulations, obtaining permission isĀ mandatoryĀ before usingĀ loudspeakersĀ in public areas.
  • Seizure of Loudspeakers:Ā Authorities have the right toĀ seize loudspeakersĀ if they are being used beyond the permissible limits.
  • DJ Systems Replacing Loudspeakers:Ā The court noted that traditional loudspeakers have been replaced byĀ DJ sound systems, which generateĀ extremely high decibel levels, leading toĀ serious environmental hazards.

The court emphasized thatĀ strict actionĀ should be taken against those who violate theĀ noise pollution limitsĀ set by the law.

Noise Pollution in Bihar: A Growing Concern

Noise pollution has become a major problem inĀ Bihar, particularly inĀ urban areas like Patna. Several factors contribute to the worsening situation, including:

1. Excessive Use of DJ and Loudspeakers

  • Religious events, political rallies, and social gatheringsĀ often involveĀ high-volume DJ systemsĀ that exceed safe sound levels.
  • PeopleĀ ignore permission rulesĀ and play music atĀ ear-damaging decibel levels, creatingĀ public disturbances.

2. Traffic and Vehicle Horns

  • Heavy traffic congestion inĀ Patna, Muzaffarpur, and GayaĀ leads toĀ excessive honking, further increasingĀ noise levels.
  • ManyĀ commercial vehicles and autosĀ installĀ modified loud horns, which significantly contribute toĀ sound pollution.

3. Construction Activities and Industrial Zones

  • RapidĀ urban development in BiharĀ has led to a rise inĀ construction noise, affecting bothĀ residents and wildlife.
  • Factories and industrial areasĀ generateĀ continuous noise, making it difficult for people to live peacefully.

4. Public Gatherings and Political Events

  • Political rallies, protests, and celebrations often involveĀ loudspeakersĀ andĀ high-volume music, leading toĀ noise disturbancesĀ in residential areas.

Impact of Noise Pollution on Public Health

Excessive noise exposure has serious consequences forĀ human healthĀ andĀ well-being. According to medical experts, prolonged exposure toĀ high-decibel soundĀ can cause:

  • Hearing Loss:Ā Constant exposure to loud sounds can lead toĀ permanent hearing damage.
  • Sleep Disturbances:Ā High noise levels, especially at night, causeĀ insomnia and sleep disorders.
  • Increased Stress & Anxiety:Ā Uncontrolled noise pollution can lead toĀ mental health issues, includingĀ stress and anxiety disorders.
  • Heart Diseases:Ā Studies indicate thatĀ prolonged exposure to loud noiseĀ can lead toĀ high blood pressure and cardiovascular diseases.

Government’s Responsibility in Controlling Noise Pollution

The Patna High Court has emphasized thatĀ controlling noise pollution is the government’s duty. StrictĀ laws and enforcement mechanismsĀ should be in place to ensure compliance.

Despite these laws,Ā lack of strict enforcementĀ has allowed noise pollution to rise in Bihar.
