Supreme Court Grants Interim Relief to Minister Vijay Shah, Orders SIT Formation in Controversial Remarks Case

KKN Gurugram Desk | In a significant legal development, the Supreme Court of India has refused to accept the apology submitted by Madhya Pradesh cabinet minister Vijay Shah over his controversial remarks against Colonel Sophia Qureshi, while granting him temporary protection from arrest.

During the hearing on Monday, 19 May 2025, a Supreme Court bench comprising Justice Surya Kant and Justice N.K. Singh directed the formation of a Special Investigation Team (SIT) to probe the matter thoroughly and submit a status report by 28 May 2025.

Background: What Did Vijay Shah Say?

Minister Vijay Shah recently came under fire for making allegedly derogatory and disrespectful remarks against Colonel Sophia Qureshi, a decorated officer in the Indian Army. During the hearing, the state counsel representing Madhya Pradesh Police informed the court that an SIT is being constituted and will comprise three directly recruited IPS officers, none of whom are from the state’s native cadre.

  • The SIT must include a senior officer of IG rank.

  • At least one woman officer must be part of the SIT.

  • The DGP must finalize the SIT formation by 10:00 AM on Tuesday (20 May 2025).

  • The SIT must function independently and impartially.

  • Periodic status reports must be submitted, with the first due by 28 May 2025.

Court to Vijay Shah: ‘Your Conduct Must Uphold the Dignity of Office’

Justice Surya Kant issued strong remarks during the hearing, criticizing Vijay Shah’s conduct and questioning the genuineness of his apology.

Quoting from the proceedings:

“Where is your apology? People often apologize only to escape legal consequences. We do not need crocodile tears. Your behavior should reflect the dignity of your office,” Justice Surya Kant told Vijay Shah’s counsel.

When Senior Advocate Maninder Singh, representing Shah, repeatedly reiterated the minister’s apology and remorse, the bench responded firmly:

“You’ll go out and say you apologized only because the court asked you to. That’s not the kind of apology we’re looking for.”

The court clarified that while it would not accept the apology at this stage, it would not order immediate arrest, allowing Shah to cooperate fully with the SIT.
