Mithun Chakraborty gets BMC notice over alleged illegal construction at Mumbai property

Published on

KKN Gurugram Desk | Veteran Bollywood actor and politician Mithun Chakraborty is once again in the headlines—but this time, it’s not for a film or a political statement. The Brihanmumbai Municipal Corporation (BMC) has issued a legal notice to the actor, alleging unauthorized construction at one of his properties in Mumbai’s Malad (Marve) region, specifically in the Erangal village area.

The civic body has warned Chakraborty of potential legal action, including demolition, if he fails to justify the legality of the structure within the stipulated timeframe.

What the BMC Notice Says

The notice was issued under Section 351 (1A) of the Mumbai Municipal Corporation Act on May 10, 2025. According to this section, property owners must provide proof that their construction is authorized and complies with municipal laws.

The BMC claims that Mithun has allegedly constructed a ground-floor structure without appropriate approvals, violating the building norms. The notice demands an explanation and proof of authorization within seven days from the date of issuance.

Failure to comply may lead to demolition of the said structure and further legal proceedings under municipal and state property laws.

The Area in Question: Erangal Village in Malad’s Marve Region

Erangal village, a coastal locality in Malad West, is known for its traditional architecture and scenic views. It has recently become a target for unauthorized real estate development, often under the radar due to its proximity to the coastline and forest areas.

The BMC has launched a crackdown on illegal structures in this zone. Officials claim to have identified over 100 unauthorized constructions, many of which are built using forged documents or without environmental clearance.

The municipal authority has set a target to demolish these structures by the end of May 2025 as part of a larger anti-encroachment drive.

Mithun Chakraborty Responds to the Allegations

Responding to media inquiries, Mithun Chakraborty has denied all allegations of illegal construction. He claimed that his property complies with all legal requirements, and that several other residents in the area have received similar notices.

“Nothing I have built is illegal. Many others in the vicinity have received notices too. We are all responding to the BMC within the legal framework,” Mithun told the press.

He emphasized that the structure in question is residential, and that he is fully prepared to cooperate with the authorities.

Why the BMC Is Intensifying Its Drive Against Unauthorized Buildings

Over the last few years, the BMC has come under pressure to enforce construction laws more strictly, especially in areas that fall under coastal regulation zones (CRZs), forest buffers, or reserved plots.

High-profile cases involving celebrities and political figures often trigger public scrutiny, leading to legal mandates for transparency and accountability.

The crackdown aims to:

  • Ensure urban planning standards are upheld.

  • Prevent ecological damage in protected areas.

  • Stop the regularization of illegal structures through political lobbying or delayed legal loopholes.

In areas like Erangal and Marve, illegal construction has reportedly led to strain on civic infrastructure, unauthorized land encroachments, and conflicts between locals and developers.

Past Cases Involving Celebrities and BMC

Mithun Chakraborty is not the first celebrity to come under BMC’s radar. Previously, several Bollywood stars and public figures have faced similar issues:

  • Shah Rukh Khan was served a notice regarding unauthorized alterations in his office premises.

  • Kangana Ranaut’s office was partially demolished by BMC in a highly publicized case.

  • Kapil Sharma, the TV comedian, was fined for construction violations in Goregaon.

These cases underscore the municipal corporation’s increased vigilance in regulating Mumbai’s densely packed and rapidly expanding urban landscape.

What Section 351 (1A) of the Mumbai Municipal Corporation Act Means

Section 351 of the Mumbai Municipal Corporation Act, 1888, empowers the civic body to:

  • Inspect properties suspected of illegal construction.

  • Issue notices demanding proof of legality.

  • Demolish any unauthorized part of the structure if satisfactory documents are not submitted within the given period.

In Mithun Chakraborty’s case, the legal process is still ongoing, but the BMC’s warning indicates zero tolerance for non-compliance, regardless of the person’s stature or celebrity status.

What Happens Next? Legal Implications for Mithun

If Mithun fails to submit valid construction approvals, several outcomes may follow:

  • Immediate demolition of the illegal portion.

  • Imposition of penalties or fines under municipal and state building codes.

  • Potential legal battle in the Mumbai Sessions Court or Bombay High Court if Mithun chooses to challenge the BMC’s actions.

Sources suggest that his legal team is preparing documentation and will file a formal response within the deadline.

Public Reaction: Divided Opinions on Social Media

The case has sparked mixed reactions on social media and public forums:

  • Some support the BMC’s action, emphasizing equal enforcement of the law.

  • Others view the notice as politically motivated, especially since Mithun is associated with a national political party.

  • A section of fans urged the actor to present his side calmly and legally, showing support for the legend.

The BMC notice to Mithun Chakraborty underscores a broader issue plaguing Mumbai — the complex and often chaotic nexus between urban expansion, unauthorized constructions, and regulatory enforcement.

While the actor maintains his innocence and vows to provide proof of legality, the incident has brought renewed focus on:

  • Celebrity accountability in real estate matters

  • BMC’s renewed assertiveness in curbing violations

  • The legal grey areas surrounding construction permits in high-demand zones

As the case unfolds, it will serve as a litmus test for the BMC’s credibility, and for Mithun, a chance to prove his compliance with the law.
