A division bench led by Chief Justice G. Narendra and Justice Alok Mehra has not only demanded an explanation from the state government but also directed the formulation of a robust safety policy to prevent future disasters.

 Why the Court Took Notice: Surge in Helicopter Accidents

Helicopters have become a lifeline for pilgrims undertaking the arduous Chardham circuit, particularly the Kedarnath Valley, which is notorious for its extreme weather and terrain. However, multiple accidents in recent years have led to tragic loss of life, prompting judicial scrutiny.

On Monday, the High Court asked pointedly during hearings:

  • “Why are these helicopter accidents occurring each year?”

  • “Are procedural lapses or operator negligence to blame?”

In response, the court pressed the Uttarakhand government to implement stringent safety protocols ahead of the next pilgrimage season.

 Unique Risks of Himalayan Aviation

During the hearing, the bench highlighted the unpredictable meteorological conditions in mountainous regions:

  • Rapid weather changes: Conditions can shift from clear skies to dense fog within minutes.

  • Post-monsoon dryness: Sudden dryness after rainfall increases the danger of stalled rotor performance.

The court emphasized that aviation companies must continuously update their pilots on localized mountain weather patterns and hazy skies, and adjust flight schedules or halt operations when conditions become unsafe.

 Temporary Suspension of Chardham Helicopter Flights

Earlier this month, the Uttarakhand government temporarily suspended helicopter services along the Chardham route, citing safety risks. This move was welcomed by aviation experts as a responsible interim measure.

Following court directives, officials confirmed that services would resume today—June 17, 2025—under strict compliance with DGCA (Directorate General of Civil Aviation) regulations and following the court-mandated safety framework.

 Key Court Directives and Government Response

1. Develop a Comprehensive Aerial Safety Policy

The High Court directed the state to design a formal policy that specifies:

  • Pilot training requirements for Himalayan terrain

  • Weather condition thresholds for suspending flights

  • Mandatory maintenance schedules

  • GPS and avionics upgrades

  • Emergency protocols and rescue response plans

2. Prioritize Experienced Pilots

The court underlined the importance of assigning only pilots with prior Himalayan flying experience to Chardham routes. The Uttarakhand government confirmed compliance with this directive, stating that only verified mountain-flight aviators will operate helicopters in Kedarnath and similar areas.

3. Enforce DGCA Safety Standards

Heli-operators have been issued mandatory compliance instructions to strictly follow all DGCA-issued guidelines, including:

  • Daily weather briefings

  • Adhering to time-slot scheduling

  • Operational transparency and incident reporting

Any operator found violating these norms will face swift and severe penalties.

 Ensuring Safety During Chardham Yatra

The new safety policy must address not only accidents but also near-miss incidents. Proposed measures include:

  • Baseline safety audits for each heli-operator before monsoon season

  • Use of Weather Radar and Multispectral Sensors aboard helicopters to detect hazardous micro-climates

  • Infrared cameras to warn pilots about changing thermal or wind conditions

  • Life jacking personnel and oxygen supplements for emergency situations

These interventions aim to turn the seasonal aerial pilgrimage into a model of safe mountain aviation.

 Administration and Pilot Accountability

The court has also urged:

  • Helicopter operators to conduct regular internal audits and publish safety bulletins

  • DGCA to strengthen its oversight of mountain-flight licensed companies

  • Uttarakhand government departments (Aviation and Tourism) to coordinate closely with experts for policy reviews

To improve passenger awareness, the court has instructed that all promotional platforms for helicopter services—online booking websites, travel agents, and helipads—must clearly display safety advisories, highlight pilot experience levels, and provide “fly-at-your-own-risk” disclaimers.

 Expert View: Balancing Pilgrim Access with Safety

Aviation analysts welcomed the court’s proactive approach, noting:

“Temporary suspension and resumption under court supervision show that authorities are learning from past mistakes,” said an aviation consultant specializing in mountain safety.
“What’s needed next is proper DGCA audit traceability and transparent post-analysis of each flight.”

They echoed the court’s position that no future cargo or passenger flight in sensitive zones should occur without mandatory weather risk charts and pilot flight logs for every sortie.

What Pilgrims Should Know

For devotees traveling during the Chardham Yatra 2025, the following precautions are advised:

  • Choose only DGCA-certified helicopter services

  • Confirm pilot’s Himalayan experience

  • Ask for safety briefings before boarding

  • Avoid last-minute bookings during late afternoons or early monsoon hours

  • Follow emergency guidelines and safety instructions strictly

The Uttarakhand government plans to launch an online platform where pilgrims can check live weather updates, flight logs, and operator safety records.

 Next Steps: Policy Timeline and Accountability

  • By June 25, 2025: Draft helicopter safety policy to be tabled in state Assembly

  • By July 1, 2025: DGCA to conduct helicopter safety audit

  • Regular quarterly reviews to address any incidents—coverage to include accident hotlines and helpline services for passengers

The newly drafted policy will also feature a Helicopter Safety Commission, tasked with regular policy audits and compliance oversight.

The Uttarakhand High Court’s intervention marks a critical turning point in addressing mountain aviation safety. By demanding transparency, experienced pilots, and strict enforcement of DGCA norms, the court and state government demonstrate a commitment to safeguarding pilgrims.

As the new helicopter seasons commence—with fresh rules, expert pilots, and modern safety systems—devotees will enjoy not just spiritual upliftment but also peace of mind during their Chardham Yatra.
